Acceptance of terms
By downloading, installing, or using the BinderSafe app or this website ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.
These terms are an agreement between you and Tembrion LLC, a limited liability company based in Sacramento, California, USA ("we", "us").
Eligibility
You must be old enough to form a binding contract in your jurisdiction (and at least 13, or the minimum age where you live) to use the Service. If you use it on behalf of an organization, you confirm you are authorized to accept these terms for it.
Your account
An account is optional and enables cloud backup, sync, and subscriptions. We offer only Sign in with Apple and Sign in with Google. You are responsible for activity under your account and for keeping your Apple or Google sign-in credentials secure. You may sign out at any time; you can also use the app offline without an account.
Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own lawful use. We reserve all rights not expressly granted.
Your content and responsibilities
You keep all rights to the files, notes, and other content you add to the app ("Your Content"). By default, Your Content stays on your device; it is uploaded to and stored in our cloud only when you enable cloud backup, to provide that service.
You are solely responsible for Your Content and for keeping your own backups. You confirm you hold the rights needed to store and use the content you add.
Cloud backup service
Cloud backup is an optional feature. When enabled, the content you choose is stored in our cloud infrastructure to support restore and sync. We may set reasonable limits on storage capacity, per-file size, or other usage, and may adjust these limits by plan. We make reasonable efforts to protect your backups, but you should still keep your own independent backups.
Subscriptions, auto-renewal, and cancellation
Premium features such as cloud backup are offered through auto-renewing subscriptions billed by the Apple App Store or Google Play. A subscription automatically renews and is charged at the end of each billing period unless you cancel at least 24 hours before the current period ends.
You can manage or cancel your subscription at any time in your device’s App Store or Google Play account settings; cancellation takes effect at the end of the current paid period. Where a free trial is offered, it converts to a paid subscription unless you cancel at least 24 hours before the trial ends. Prices and tiers may change, and we will give advance notice where required by law; refunds are handled by the relevant app store under its policies.
A subscription is billed to and tied to the app-store account (your Apple ID or Google account) used to make the purchase, regardless of how you sign in to BinderSafe; payment is made through that app-store account. Premium cloud features require signing in to your BinderSafe account. Using "Restore Purchases" associates the subscription held by that app-store account with the BinderSafe account you are currently signed in to; a given subscription is active under only one BinderSafe account at any time.
Auto-renewing subscriptions purchased through the Apple App Store are also subject to Apple’s standard End User License Agreement (EULA).
Acceptable use
You agree not to use the Service to store or share unlawful content, to infringe the rights of others, to attempt to breach security, or to reverse engineer, decompile, or interfere with the Service, except to the extent the law permits despite this restriction.
App stores and third-party terms
If you install the app from a third-party app store, your use is also subject to the terms of that store. Sign-in and subscriptions involve third-party services including Apple, Google, and RevenueCat, and are subject to their respective terms. Third-party open-source components are provided under their own licenses, listed in the app under Settings → Open source licenses.
Intellectual property
The BinderSafe name, logo, and the design and layout of the app and website are owned by Tembrion LLC or our licensors. These terms do not grant you any right to use them except as needed to use the Service normally.
Availability and changes
We provide the Service on an "as is" and "as available" basis and may add, change, or discontinue features. We make reasonable efforts to keep the Service available but do not guarantee it will be uninterrupted.
Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, Tembrion LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data or content, arising from or related to your use of, or inability to use, the Service.
Termination and account deletion
You may stop using the Service and uninstall the app at any time; uninstalling removes on-device data unless your operating system keeps its own backups. You may also delete your account, and we will remove your account record and cloud-backup content (except where the law requires retention); subscriptions must still be cancelled separately in the relevant app store. We may suspend or end your access if you breach these terms or to comply with the law.
Changes to these terms
We may update these terms as the Service evolves. Material changes will be reflected in the effective date below. Continued use after an update means you accept the revised terms.
Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Nothing in these terms limits any mandatory consumer-protection rights you have where you live.
